摘要
医务人员直播科普医学常识时的问诊不同于互联网诊疗、远程诊疗.我国目前还没有法律针对医务人员直播带货行为做出明确规定,也未见有对医务人员直播带货问诊行为法律规制问题的讨论.国家卫生健康委员会等九部委联合印发的《2022年纠正医药购销领域和医疗服务中不正之风工作要点》(以下简称《要点》)提出"严肃查处医疗机构工作人员利用职务、身份之便直播带货",为医务人员直播带货敲响警钟.以三个典型案例为例,从概念、类型、特征、性质等方面对医务人员直播带货行为进行分析,并对具体行为的法律规制问题进行探讨.
Abstract
The inquiry diagnosis and treatment of medical personnel live broadcast of popular medical knowledge is different from the Internet diagnosis and treatment,remote diagnosis and treatment.At present,there is no law in China clearly specifies that the behaviors of live commerce of medical personnel.There is no discussion on the le-gal regulations of the behaviors of inquiry diagnosis and treatment while the medical personnel live broadcast of pop-ular medical knowledge.Nine ministries and commissions,including the National Health Commission,jointly issued the"Key Points for Correcting unhealthy Habits in the field of Medicine Purchasing and Marketing and medical Services in 2022"(hereinafter referred to as the"Key Points"),which put forward"The medical personnel who take advantage of their positions and identities to live commerce will be seriously investigated and punished."This is the alarm for medical personnel to live commerce.Taking three typical cases as examples,this paper analyzed the live commerce behavior of medical personnel from the aspects of concept,type,characteristics and nature,and discussed the legal regulation of the specific behavior.
