摘要
为进一步规范卫生行政处罚行为,构建应受卫生行政处罚行为认定的思维体系,参照刑法犯罪构成二阶层理论体系思维模式,从事实判断和价值判断两个阶层对肖某非医师行医致人伤害事件进行了深入的剖析,浅析了应受卫生行政处罚行为的构成要件,为卫生行政执法者提供了新的思维模式.
Abstract
In order to further standardize administrative penalties for hygiene,and to construct a thinking sys-tem for the recognition of such penalties,this article refered to the two-tier theory system of criminal law constitu-tive elements and conducted a profound analysis of the event where Xiao,a non-doctor,caused harm while practicing medicine.The analysis included both factual and value judgments,and provided a shallow analysis of the constitu-tive elements of administrative penalties for hygiene.This article provided a new thinking model for health adminis-trative law enforcement officials.
