突发公共卫生事件城市居民委员会治理中法定权限的再规范
Re-standardization of residential committee authority in the management of public health emergencies

摘要
居民委员会在新冠疫情防控中,出现因公共卫生治理中相关法律规定不周延而导致其在抗疫实践中出现了大量责权混乱的现象,引发了民众对于居民委员会的防疫手段和举措强烈不满,居民委员会与普通民众间的冲突愈发激烈.盘点现行法律进一步分析,主要法律问题在于居民委员会执行防疫权限范围不明确以及居民委员会自治权越界.结合法理剖析针对此类问题,建议主要完善两点:一是划定居民委员会协助工作的范围;二是加强居民委员会的内外部监督,可以有效缓解目前居民委员会"权小责大"的实际问题,助力其更好地发挥自身作用,参与到我国疫情防控体系之中来.
Abstract
Due to the inadequacy of relevant laws and regulations in public health management,residents'com-mittees have had a lot of confusion of responsibilities in the practice of COVID-19 prevention,which caused fierce conflicts between residents'committees and ordinary people.A review of the current laws shows that the main legal problems lie in the unclear scope of the residents'committee's authority to carry out epidemic prevention and the vio-lation of the autonomy of the residents'committee.According to legal analysis,there are two main suggestions to improve this kind of problem:first,delimit the scope of the residents committee to assist the work;second,strengthening the internal and external supervision of urban residents committees can effectively alleviate the current practical problem of residents committees with little power and great responsibility,and help them better play their role and participate in China's epidemic prevention and control system.
