Variation and development of the informed consent system in emergency medical treatment
Article 1220 of the Civil Code on emergency medical treatment is an abnormality of the patient's right to informed consent,that is,if a medical institution cannot obtain the opinion of the patient in an emergency,the corresponding medical measures can be implemented immediately after the approval procedure,which will protect the life and health of the critically ill patient to the greatest extent.However,in the process of implementation,peo-ple's understanding of this system is different,and the system design itself has shortcomings,accurately defining the nature of emergency medical treatment,studying whether the procedure"with the consent of the person in charge of the medical institution"is suitable for the nature of emergency medical treatment,and analyzing whether medical in-stitutions have the obligation to identify the identity of patients'close relatives in emergency situations and what kind of identification obligations they have,which will have important theoretical and practical significance for giving play to the value of the emergency medical treatment system.
