The key to promoting the inheritance and innovation of Traditional Chinese Medicine(TCM)is to ef-fectively link the protection of TCM knowledge with the modern intellectual property system and further improve the comprehensive protection system of TCM intellectual property.At present,TCM intellectual property protection system has been established.However,due to the characteristics of TCM,the protection of TCM intellectual prop-erty under the existing system is facing difficulties.We should learn from the mature experience of intellectual prop-erty protection in TCM in foreign law,advance special legislation on intellectual property of TCM,establish a re-source library system for state-owned prescription,establish a special protection period system for patent of TCM,improve the patent granting process,and promote the innovative development of intellectual property of TCM.
