摘要
目的:了解打击代孕立法现状和监管难点,提出全链条防范和打击代孕工作机制.方法:分析现行有效的法律法规和既存的司法案例.分析:导致监管难题的原因,并给出对策.结果:打击代孕存在发现难、取证难、查处难、联动难等困难,打击机制尚未形成,需要进一步建立全链条防范和打击代孕工作机制.结论:建议完善立法,加强宣传,筑牢基层排查网,强化人防技防措施,构建监管数据平台,形成综合治理的打击机制.
Abstract
Purpose:To understand the current legislation status and regulatory difficulties in combating surro-gacy,and put forward a working mechanism for preventing and combating surrogacy in the whole chain.Methods:Analyzing the current effective laws and regulations and existing judicial cases,and analyzing the causes of supervi-sion problems to give countermeasures.Results:The crackdown on surrogacy is difficult to find,obtain evidence,investigate and coordinate,and other difficulties.The crackdown mechanism has not yet been formed,and it is nec-essary to further establish a full-chain working mechanism to prevent and combat surrogacy.Conclusion:It is sug-gested to improve legislation,strengthen publicity,build a solid grassroots screening network,strengthen technical and defense measures for air defense,building a regulatory data platform,and form a comprehensive attack mecha-nism.
