《深圳经济特区医疗条例》违法所得的认定与适用

摘要
新版《行政处罚法》将没收违法所得规定为行政处罚的一种,补足了单纯罚款对违法行为惩罚力度不足的问题.但是,目前该法仅对违法所得的概念、性质做了原则性规定,对违法所得的认定标准、计算规则尚未及时跟进,从而导致卫生行政执法人员在适用没收违法所得条款时存在认识不清、处断不一等情形.新版《深圳经济特区医疗条例》于2023年1月1日起生效,在制定过程中充分吸收运用了没收违法所得的处理原则.通过梳理该条例涉及没收违法所得的共3大类7个违法行为,分析讨论了根据3大类违法行为的特点分别适用没收违法所得规则,以期在行政执法中正确适用法律,更好发挥评价教育作用.
Abstract
The new Administrative Penalty Law stipulates the confiscation of illegal proceeds as a form of ad-ministrative penalty,which remedies the problem of insufficient punishment for illegal acts through simple fines.However,the Administrative Penalty Law only provides principle provisions on the concept and nature of illegal pro-ceeds,and the health administrative regulations have not yet followed up on the recognition criteria and calculation rules for illegal proceeds,which leads to unclear understanding and inconsistent handling by health administrative law enforcement personnel when applying the clause of confiscating illegal proceeds.The new Shenzhen Special Eco-nomic Zone Medical Regulations,which came into effect on January 1,2023,fully absorbed and applied the handling principles of confiscating illegal proceeds during the formulation process.The author sorted out a total of 3 major categories and 7 illegal acts involved in the confiscation of illegal proceeds in the Special Economic Zone Medical Reg-ulations,and analyzed and discussed the application of confiscating illegal proceeds rules based on the different char-acteristics of the 3 major categories.The purpose is to correctly apply the law,fully play the disciplinary role while implementing the Special Economic Zone Medical Regulations,and better evaluate and educate society,thereby a-chieving better social benefits.
