后疫情时代发展国际医疗旅游的法律风险及其对策研究

摘要
国际医疗旅游作为全球增长最快的健康产业之一,给我国经济发展和扩大对外影响注入了新的活力.随着新冠疫情步入与人类共存阶段,后疫情时代我国国际医疗旅游的发展挑战与机遇并存.目前,我国建立了 4个医疗旅游先行区,在推广我国中医药及成熟的医疗技术的同时,从多个发展方位刺激入境医疗旅游消费.但是,发展国际医疗旅游产业仍然存在诸多问题,其中专门性立法供给不足、现行法律对医疗旅游行业的限制过紧、中西医的国际化差异、先端医疗的立法缺失等问题可能会带来诸多法律风险.我国需要借鉴国际医疗旅游的制度性经验,签发国际医疗旅游签证、加强对医疗旅游机构政策及法律支持、建立完善的国际医疗旅游法律法规体系、填补中医国际医疗旅游立法空白、支持并约束先端医疗技术的发展.
Abstract
As one of the fastest growing health industries in the world,international medical tourism has injec-ted new vitality into our economic development and foreign influence expansion.The post-COVID-19 era is approac-hing,and the development of China's international medical tourism faces great challenges.At present,four medical tourism antecedents have been established in our country to stimulate the entry medical tourism consumption from various developing directions while promoting Chinese traditional medicine and mature medical technology.Howev-er,the development of the emerging international medical tourism industry coexists with risks,among which,the shortage of specialized legislation,the tight restrictions of the current laws on the medical tourism industry,the in-ternational differences between traditional Chinese and Western medicine,the lack of legislation of advanced medical treatment and other problems may bring many legal risks.China needs to learn from the institutional experience of medical tourism in the United States,Japan and South Korea,issue international medical tourism visas,strengthen the policy and legal support for medical tourism institutions,establish a perfect system of international medical tourism laws and regulations,fill the legislative gap of TCM international medical tourism,and support and restrict the development of advanced medical technology.
