近年来,预制菜凭借其快速便捷的优势迅速发展,但其中的食品安全问题引发了公众的广泛担忧.当前预制菜产业内部乱象频发,"作坊式"生产、生产经营混同、冷链配置差等问题十分突出.通过对现有相关法律法规进行分析,可以发现针对预制菜的规定总体呈现"有而不全"的特点,需要从完备法律体系、明晰法律性质、加强法律监管、落实法律责任四个方面寻求破解难题的方法.在预制菜产业的后续发展方向上,需要生产经营企业、消费者、食品安全监管部门三方主体共同发力、密切配合,最终推动预制菜产业形成统一、完整、稳定的产业链条.如此,才能真正实现预制菜产业的行稳致远.
Prefabricated Dishes:Legal Analysis and Direction Exploration
In recent years,prefabricated dishes have developed rapidly with their fast and convenient advanta-ges,but the food safety problems have also aroused widespread public concern.At present,there are frequent inter-nal chaos in the prefabricated food industry,and problems such as"workshop"production,mixed production and operation,and poor cold chain configuration are very prominent.Through the analysis of the existing relevant laws and regulations,it can be found that the provisions on prefabricated dishes generally present the characteristics of"there are but not complete",and it is necessary to find ways to solve the problem from four aspects:complete legal system,clarify the nature of law,strengthen legal supervision,and implement legal responsibility.In the follow-up development direction of the prefabricated food industry,it is necessary for production and operation enterprises,consumers,and food safety supervision and management departments to work together and cooperate closely,so as to finally promote the formation of a unified,complete and stable industrial chain of the prefabricated food industry.In this way,we can truly realize the steady and far-reaching development of the prefabricated food industry.
