Clarification of the Nature of Disciplinary Actions Against Students in the Context of Higher Education
Influenced by the Theory of Special Power Relations,traditionally,our universities have dealt with their relationships with students based on internal legal relationships.The schools impose disciplinary actions on students who violate educational laws and regulations or disrupt educational management order,with judicial reme-dies limited to the deprivation of a student's right to education,leaving students'rights inadequately protected.Through analysing 114 cases of educational administrative disputes and rightsremedies between universities and students,It is found that the ambiguity in characterizing these disciplinary actions and differences in understand-ing have resulted in disadvantages for students seeking remedies for their rights.This article,guided by this issue and based on an examination of academic perspectives,attempts to clarify the nature of disciplinary actions by an-alyzing the external characteristics of how universities discipline students.It aims to establish that the sanctions imposed by universities on students who violate educational administrative laws and school rules constitute a form of educational administrative punishment.
