替代还是赋能:人工智能教学对教师教学权的冲击及其应对

人工智能只能赋能教师教学,不可能替代教师行使教学权。从权利的生成逻辑来看,教师教学属于公共性、专业性与法定性相统一的权利,替代型人工智能教学论者所倡导的完全替代型教学与部分替代型教学存在着权利主体公共性缺失、专业义务履行不能与法律责任承担不能的法治困境,故而不应对教师教学权产生实质性冲击。但人工智能却可能成为衡量教师教学能力的重要因素,使得教师教学发生内部技术性替代,进而导致部分教师丧失教学权。为了保障人工智能时代教师的教学权利,应构建起教师智能教学权主体性的法律保障体系,加强对教师行使智能教学权条件与能力的保障力度,并为教师保留一定的智能教学方式自主选择空间。
Substitution or Empowerment:The Impact and Response of Artificial Intelligence Teaching on Teachers'Teaching Rights
Artificial intelligence can only empower teachers to teach and cannot replace teachers in exercis-ing their teaching rights.According to the logic of the generation of rights,teacher teaching belongs to a right that combines publicity,professionalism,and legality.The completely substituted teaching advocated by artificial intelligence teaching theorists and partially substituted teaching have a legal dilemma such as the lack of publici-ty of the rights subjects,the inability to fulfill professional obligations,and the inability to bear legal responsi-bilities.Therefore,it should not have a substantive impact on the teaching rights of teachers.However,artificial intelligence may become an important factor in measuring teachers'teaching abilities,leading to internal techno-logical substitution in teaching and ultimately leading to the loss of teaching rights for some teachers.In order to protect the teaching rights of teachers in the era of artificial intelligence,a legal protection system should be established to protect the subjectivity of teachers'intelligent teaching rights,strengthen the protection of the conditions and abilities for teachers to exercise their intelligent teaching rights,and reserve a certain space for teachers to independently choose intelligent teaching methods.
