我国笑气滥用问题及其规制研究

摘要
近年来,笑气等毒品替代物质滥用问题引发我国社会关注.梳理这一问题现状发现:禁毒实践层面中笑气被视为毒品并加以严格管制,司法适用层面中涉笑气行为与毒品类犯罪相关联,个体认知层面中公众对笑气具有一定的认知.在考察荷兰和英国笑气滥用问题规制实践基础上,建议进行笑气列管可行性评估工作,统一笑气类案件法律适用标准,强化全链条笑气监管举措,优化笑气滥用预防教育工作,以期为我国探索非列管滥用物质的管制制度提供可能性思路.
Abstract
In recent years,the abuse of drug substitutes such as laughing gas has attracted attention in Chinese society.Analyzing the current situation of this issue,it was found that in the practice of drug control,laughing gas is regarded as drug and strictly controlled.At the judicial application level,there is a correlation between laughing gas related behavior and drug related crimes.At the individual cognitive level,the public has a certain understanding of laughing gas.Based on the investigation of regulatory practices on the abuse of laughing gas in the Netherlands and the United Kingdom,it is recommended to conduct a feasibility assessment of laughing gas management,unifying the legal application standards for laughing gas cases,strengthening the entire chain of laughing gas supervision measures,optimizing the prevention and education of laughing gas abuse.It will provide a possible idea for China to explore a control system for non-regulated substances of abuse.
