摘要
体育兴奋剂和毒品都属于物质滥用范畴,相关违法犯罪具有隐蔽性,侵犯了多重法益,种类也存在重叠.由于竞技体育中对业绩的盲目追求、物质滥用市场的逐利性和现代科技的介入,兴奋剂问题屡禁不止.同时,我国在体育兴奋剂管制方面也面临着一些挑战,如管制种类更新滞后、兴奋剂滥用向青少年体育和社会体育蔓延,以及检测程序存在缺陷等.本文通过借鉴我国毒品管制经验,在完善体育兴奋剂管制制度、动态调整兴奋剂列管种类、加强执法协作、加大科技助力等方面提出了建议.希望通过借鉴毒品管制经验,积极应对我国当前体育兴奋剂管制所面临的挑战,进一步完善我国体育兴奋剂管制制度.
Abstract
Both doping and drugs fall under the category of substance abuse,and related illegal crimes have concealment,infringing multiple legal interests and overlapping types.Due to the blind pursuit of performance,profit-seeking behavior in the substance abuse market,and the aid of modern technology,the issue of doping persists.Meanwhile,China's regulation of doping drugs faces challenges such as list updating lagged,the spread of doping misuse to youth sports and social sports,and imperfection of testing procedure.Drawing on China's experience in narcotics control,this article proposes enhancements in the regulation of doping,dynamic adjustments to the controlled substances list,strengthened law-enforcement collaboration,and increased technological support.The article aims to actively address the current challenges in China's regulation of doping and further refine the regulatory framework in this area.
