摘要
《区域全面经济伙伴关系协定》(RCEP)作为首个载有数据跨境流动规则条款的自由贸易协定已全面生效,其关于数据跨境流动的新规定在充分尊重国家数据主权基础上,鼓励数据跨境流动,原则上禁止限制同时设置例外条款,尝试建立"共商共建共治"的数据治理合作模式,推动区域数字治理,突破影响全球数据流动规则.
Abstract
The Regional Comprehensive Economic Partnership(RCEP)has entered into force as the first free trade agreement containing provisions on the rules of cross-border flow of data,and its new provisions on cross-border flow of data encourage cross-border flow of data on the basis of full respect for the sovereignty of national data,and in principle prohibit restrictions while setting up exception clauses,attempting to establish a cooperation model of data govern-ance based on"joint consultation,common construction and common governance",promoting regional digital governance,and making breakthroughs in influencing the rules on the flow of data globally.
