摘要
2016 年 4 月,最高人民法院印发《关于开展家事审判方式和工作机制改革试点工作的意见》,包括 118 家试点法院在内的全国近500家中基层法院同时启动了为期两年的家事审判方式和工作机制改革试点,形成了一批符合家事审判规律的经验做法.但自2018年以来,受基层法院内设机构改革、新冠疫情、繁简分流改革等多重因素影响,试点法院改革积极性有所减弱,制度机制的健全完善推进缓慢.针对改革实践中出现的工作推进不平衡、审判组织专业化程度不高、队伍专业化程度不强、审判程序法律法规缺乏专门性、家事审判配套制度不健全等问题,本文结合域外立法、试点法院已有的成功经验,建议以完善家事调解、家事调查等家事审判专业化制度机制为基础,结合当前法院审判及机构实际情况,组建集家事审判、少年审判为一体的少年家事法庭,推动制定家事诉讼特别程序法,更好的汇聚法院合力推动构建家事审判社会化工作格局,确保人民法院在维护家庭和谐稳定,促进社会文明进步中贡献应有力量.
Abstract
In 2016,the Supreme People's Court issued the Opinions on Conducting Pilot Reforms of Family Trial Methods and Mechanisms,initiating a two-year pilot reform across 118 designated courts and nearly 500 intermediate and grassroots courts nationwide.This initiative led to the development of practices aligned with the principles of family adjudication.However,since 2018,multiple factors,including the restructuring of grassroots court institutions,the COVID-19 pandemic,and the implementation of the bifurcation of complex and simplified procedures,have diminished the reform enthusiasm in pilot courts,resulting in slow progress in enhancing institutional mechanisms.This paper addresses several issues emerging from the reform process,such as uneven progress,insufficient professionalization of adjudication organizations,inadequate specialization of judicial teams,lack of dedicated legal procedures for family trials,and underdeveloped supporting systems.Drawing on comparative legal frameworks and successful practices from pilot courts,the paper proposes improving specialized mechanisms for family mediation and investigation.It recommends integrating family and juvenile court functions into a unified Juvenile and Family Court system and advocates for the development of a specialized procedural law for family litigation.This approach aims to leverage the judiciary's collective capacity to establish a comprehensive societal framework for family adjudication,ensuring that the People's Courts play a significant role in maintaining family harmony and stability,and promoting societal civility and progress.
