摘要
通过对 1700 余份陪审员调查问卷的分析,验证了合议庭结构对陪审员实质参审存在着影响.总体来看,在规模越大、陪审员所占比例越高的合议庭中,陪审员更能实质参审.而且,在不同合议庭结构中,影响陪审员实质参审程度的因素并不完全相同.在陪审员数量和占比较低的合议庭中,陪审员实质参审程度的提升更依赖于合议庭民主氛围的提升;而在陪审员数量和占比较高的合议庭中,陪审员实质参审程度的提升更依赖于庭审实质化的实现程度.为进一步提升陪审员实质参审程度,可在不同合议庭中采用更符合陪审员认知和决策规律的合议庭选择机制,并在不同合议庭中采用更加有针对性地提升陪审员实质参审程度的方式.
Abstract
It is proved that the quality and effectiveness of lay judges'participation in trials could be influenced by the collegial benches'structure through the analysis of more than 1700 pieces of lay judges'questionnaires.Generally speaking,the lay judges would be more active in the collegial bench with the larger scale and a high proportion of lay judges.Moreover,the factors that affect the quality and effectiveness of lay judges'participation in trials are different in different kinds of collegial benches.In the collegial benches with a relatively low number and proportion of lay judges,the improvement of the quality and effectiveness of lay judges'participation is more dependent on the improvement of the democratic atmosphere of the collegial benches.However,in the collegial benches with a high number and proportion of lay judges,the improvement of the quality and effectiveness of lay judges'participation in trials is more dependent on the degree of realization of the substantive trial.In order to further improve the quality and effectiveness of lay judges'participation in trials,a selection mechanism of collegial benches should be adopted which is more in line with lay judges'cognition and decision-making rules,and a more targeted approach to improving the quality and effectiveness of lay judges'participation in trials should be adopted in different collegial benches.
