社会治理现代化视域下执行案件前端治理的思考

摘要
"执行难"是社会运行中各种社会问题和矛盾叠加、交织的集中体现,与社会诚信体系建设、市场主体抗风险能力及退出机制、预防性法律制度体系等因素密切相关."执行难"已然成为社会治理现代化进程中的难题之一,反映了我国现阶段深入推进社会治理能力现代化的必要性.以习近平法治思想为指导,抓前端、治未病,促进切实解决执行难,推动社会治理效能不断提升,是答好人民之问、时代之问、治理之问的新时代重大课题.本文旨在通过厘清执源治理的价值目标、基本要求和科学内涵,在司法治理的实践中总结经验,健全执行案件前端治理工作体系,推动社会治理理念、治理体制、治理方式、治理能力现代化.
Abstract
"Difficulty in enforcement"is a concentrated embodiment of the superposition and interweaving of various social problems and contradictions in social operation,and is closely related to factors such as the construction of the social credit system,the ability of market entities to resist risks and exit mechanisms,and the system of preventive legal systems."Difficulty in enforcement"has become one of the difficult problems in the process of social governance modernization,reflecting the necessity of China's in-depth promotion of social governance capacity at this stage.Guided by Xi Jinping Thought on the Rule of Law,grasping the front end,curing the disease before it happens,promoting the effective resolution of difficulties in implementation,and promoting the continuous improvement of the efficiency of social governance are major topics in the new era to answer the questions of the people,the times,and governance.This paper clarifies the value objectives,basic requirements and scientific connotation of governance at the source of enforcement,summarizes experience in the practice of judicial governance,improves the front-end governance system of enforcement cases,and promotes the modernization of social governance concepts,governance systems,governance methods,and governance capabilities.
