摘要
发展新质生产力,需要新的制度供给尤其是知识产权保护为技术变革和创新策源提供服务与保障.新形势下,科技创新引领发展决胜未来,产业转型升级重塑融合发展,国际竞争空前激烈形势复杂.知识产权保护在新的生产力发展形势之下,其主要任务就是要为新质生产力的发展提供优质的服务保障.作为新质生产力的重要内容,数字经济领域的竞争正演变为以数据和算法为核心的生态系统竞争,而基于数据和算法的法律风险亟待关注与防范.为更好地服务保障新质生产力发展,知识产权保护应当秉持严格保护、开放包容和统筹协调的保护理念,从服务科技创新、产业升级、市场发展和社会治理等不同维度开展分类施策.
Abstract
Developing new quality productive forces requires new mechanisms supplies,especially the intellectual property protection system,to provide services and safeguards for technological transformation and fostering original innovation.Under new circumstances,technological innovation leads development and determines the future while industrial transformation and upgrading reshape integrated development.International competition is unprecedentedly fierce and complex.Under the new situation of productive force development,the main task of intellectual property protection is to provide high-quality service guarantees for the development of new quality productive forces.As an important part of new quality productive forces,competition in the field of digital economy is evolving into ecosystem competition with data and algorithms as the core.Legal risks of data and algorithms need urgent attention and prevention.To serve and safeguard the development of new quality productive forces better,the protection of intellectual property rights shall adhere to strict,open,inclusive,and coordinated protection.Countermeasures should be implemented from different dimensions such as service scientific and technological innovation,industrial upgrading,market development and social governance.
