目的 研究应用来源披露制度保护我国传统医药的可行性及措施.方法 对来源披露制度的关键因素和我国传统医药的内涵及法律保护环境加以分析.结果 与结论应用来源披露制度保护我国传统医药可行度高,构建该制度保护我国传统医药,关键是要在专利法中增加对传统知识的来源披露和披露传统医药思想.
Objective To study the feasibility and measures on applying disclosure of origin regime to protect traditional Chinese medicine. Methods the key elements of disclosure of origin regime and the connotation and the environment of legal protection of traditional Chinese medicine were analyzed. Results & Conclusions the practicability of applying disclosure of origin regime to protect traditional Chinese medicine is high. To disclose the origin of traditional knowledge and the thoughts of Traditional Medicine were the key point of constructing the regime to protect traditional Chinese medicine.
