摘要
治理有效一直是乡村振兴战略的重要目标之一,在乡村振兴的背景下推动乡村治理体系和治理能力的现代化,离不开软法治理.软法在构建完整治理体系、助力多元化的涉农纠纷和塑造乡村法治环境上具有巨大的推动作用,是法治乡村建设中的生力军.但软法治理依然存在软法效力不足、软法自治自动力不足和软硬法之间不协同的问题.要充分发挥软法治理的效能,就要加强软法治理的系统构建、调动自治的积极性并连通软硬法的转化路径,让软法治理为乡村振兴发展更好地保驾护航.
Abstract
Effective governance has always been one of the important goals of Rural Revitalization Strategy.Soft law governance is indispensable to promote the modernization of rural governance system and governance capacity in the context of rural revitalization.Soft law plays a huge role in building a complete governance system,helping diversified agriculture-related disputes and shaping the environment of the rule of law in rural areas.It is a new force in the rural construction of the rule of law.However,there are still some problems in the governance of soft law,such as the lack of effectiveness of soft law,the lack of autonomy of soft law and the lack of coordination between soft law and hard law.In order to give full play to the effectiveness of soft law governance,it is necessary to strengthen the system construction of soft law governance,mobilize the enthusiasm of autonomy and connect the transformation path of soft law and hard law,so that soft law governance can better protect the development of rural revitalization.
