Status of Application and Authorization for Protection of New Varieties of Tea Plants in China
In order to clarify the application and authorization status of new tea[Camellia sinensis(L.)Kuntze]tree varieties in China,the application and authorization information of new tea tree varieties in China were collected and sorted out,and the protection status of new tea tree varieties was analyzed from different application channels,different regions and different application subjects.The results showed that as of December 31,2023,a total of 501 applications for protection of new varieties of tea trees in 76 batches and 172 variety rights authorization announcements in 28 batches,with an authori-zation rate of 34.26%.The duration from application to authorization announcement of 172 new varie-ty rights of tea trees lasted from 0.53 to 7.36 years,with an average authorization period of 4.11 years.The National Forestry and Grassland Administration declared 33 new varieties of tea tree protection,and authorized 30,with an authorization rate of 90.90%and an average authorization period of 1.19 years;The Ministry of Agriculture and Rural Affairs declared 469 new varieties of tea tree protection,and authorized 142,with an authorization rate of 30.28%and an average authorization period of 4.73 years.A total of 132 units or individuals submitted applications for the protection of new varieties of tea trees,44 were granted the right to new varieties of tea trees as variety owners,and scientific re-search institutes were the largest application and authorization subjects,the number of applications and authorization was 374 and 124,accounting for 74.50%and 72.09%respectively.Tea Research In-stitute of Chinese Academy of Agricultural Sciences had the highest number of applications and au-thorizations for the protection of new varieties of tea trees,accounting for 95 and 55,respectively,ac-counting for 18.92%and 31.98%,while Ningbo Golden Yun Tea Technology Co.,Ltd.applied for 28 and authorized 25,with the highest authorization rate(89.29%).
