摘要
目的 为解决医疗技术"卡脖子"问题,医疗机构越来越重视科技成果转化.但医疗科技成果转化具有高风险、高收益的双重属性,因此必须注重防范化解医疗机构科技成果转化过程中的风险.方法 本文以中国医学科学院阜外医院成果转化实践为例进行分析,对医院科技成果转化的常规路径以及转化实践进行归纳、探索.结果 从法律角度提炼出当前科技成果转化不同方式面临的风险点.结论 提出法律风险规避措施,为科学、规范、合法、合规开展医疗机构科技成果转化提供思路和建议.
Abstract
Objective To solve the"bottleneck"problem of medical technology,medical institutions are increasingly paying at-tention to the transformation of scientific and technological achievements.however,the transformation of medical scientific and techno-logical achievements has the dual attributes of high risk and high income.So we must prevent and resolve risks in the process of trans-formation of scientific and technological achievements in medical institutions.Methods The author analyzed the conventional path and transformation practice of the transformation of scientific and technological achievements in Fuwai Hospital.Results Extracts the risk points faced by different ways of transformation of scientific and technological achievements from a legal perspective.Conclusions Pro-poses circumvention measures of legal risks,to provide ideas and suggestions for scientific,standardized,legal and compliant transfor-mation of scientific and technological achievements of medical institutions.
