Procuratorial public interest litigation is a public interest litigation in the field of archives protection,which refers to the public interest litigation initiated by the procuratorial organ as the plaintiff to protect the archives.Archives are the wealth of the country and even the whole mankind,and the protection of archives is also of public welfare,involving the protection of the spiritual interests of the unspecified majority.Archives protection procuratorial public interest litigation is a legal system born to protect this social public interest,and belongs to the special procuratorial public interest litigation for the protection of cultural relics and cultural heritage.Our country should recognize the legitimacy and necessity of archives protection as an independent procuratorial public interest litigation type.In the legislation,our country should carry out special legislation on the protection of archives procuratorial public interest litigation,and add procuratorial public interest litigation clauses in the Archives Law.In terms of system,China needs to clarify the criteria of damage identification,the conditions of prosecution and the types of litigation requests,and establish an integrated implementation model of prosecutorial public interest litigation.In terms of measures,China should expand the channels of public participation,which includes expanding the channels of lead discovery,protecting the public's right to participate in the process,and widely accepting the public's supervision of the outcome of the lawsuit.
