New directions for the development of administrative subject theory from the perspective of cooperative governance
With the development of the times,cooperative governance has gradually become the mainstream of administrative governance models.The theory of administrative entities is gradually difficult to reconcile.The theory of administrative subject should be divided into functional administrative subject and authority administrative subject,and the status of functional administrative subject should be given to the private subject performing administrative functions.To terminate the joint and several relationships between the administrative subject and the defendant in administrative litigation,the confirmation of the defendant in public-private cooperation should first determine whether the private subject is a functional administrative subject.We should expand the scope of administrative mediation and remove the difficulties faced by the administrative litigation system in the context of public-private cooperation.
