Reflections on the evidence-free effect of arbitration awards
The fact confirmed by an effective arbitration award belongs to the category of evidence-free facts. This thesis analyzes the problems and reasons for the application of evidentiary norms in arbitration awards in judicial practice.Assisted by comparative law research,it is more reasonable to recognize the evidence-free effect of effective arbitration awards as evidentiary effect. In terms of application scope, the subject should be limited to the same party and the object should be limited to facts that have been fully verified. This will help to construct a diversified pattern for resolving conflicts and disputes.
