摘要
分析算法驱动下轴辐协议的规制难题,结合现实情况与域外反垄断执法经验,借助"平行行为+附加因素"的方式综合认定经营者之间的合谋意图,执法机构通过研发或者采购算法规制系统,构建事前预测、事中主动介入的技术监管体系.轴辐协议本质上仍然是横向垄断协议,对其违法性,在整体上应当适用本身违法原则,按照作用力大小进行责任分配.
Abstract
The regulatory difficulties of axis and spoke protocol driven by algorithms are analyzed,practical situations and foreign anti-monopoly enforcement experiences are combined,and the method of"parallel behavior plus additional factors"is used to comprehensively determine the collusion intentions between operators.Law enforcement agencies construct a technical regulatory system that predicts in advance and actively intervenes in the process through research and development or procurement algorithm regulatory systems.The axis and spoke protocol is essentially a horizontal monopoly agreement,and its illegality should still be governed by its own illegality principle as a whole.Responsibility should be allocated to the participating axis entities and spoke operators according to the magnitude of their respective forces.
