摘要
过度网络透明化管理不仅导致网络社会公域的无限扩张,消解人的个性发展,而且带来新的网络个人信息犯罪风险.应实行有限的匿名治理制度,重构虚拟社会公私域的界限,以消除过度透明化管理与信息犯罪的啮合.基于有限匿名的思路,建立统一的网络身份认证系统,明晰当前信息犯罪规制体系的保护对象,并对信息类犯罪进行分类分级治理,实现维护网络安全与人权保障的平衡.
Abstract
Excessive network transparent management not only leads to the infinite expansion of the public domain of the network society,dissolves the development of human personality,but also generates new risks of network personal information crime.Therefore,it is necessary to implement limited anonymous governance system and reconstruct the boundary between public and private domains in virtual society so as to eliminate the meshing between excessive transparent management and information crime.Based on the idea of limited anonymity,a unified digital identity certificate should be built to clarify the protection objects of the current regulation system of information crimes,and information crimes should be classified and governed accordingly to achieve a balance between safeguarding network security and protecting human rights.
