当前,以ChatGPT为代表的生成式人工智能已经从单一的数据生成模型过渡到多元的大数据生成模式,并引发了多重法律风险,传统的归责方式不再适用于AI类犯罪.对此,应当重点在生成式人工智能前期抓取数据阶段细化责任,防止"责任堆积"造成的混淆局面.将数据保护和责任归属两者相互融合交叉,结合法律原则,通过"治标又治本"的手段,达到归责完善和保护数据的双重目的.
At present,the generative artificial intelligence represented by ChatGPT has transitioned from a single data generation model to a multiple big data generation model,which has caused multiple le-gal risks,and the traditional way of responsibility attribution is no longer applicable to AI crimes.In view of this,it is advisable to refine responsibilities in the early stage of data capture by generative artificial in-telligence to prevent the confusion caused by responsibility accumulation.Finally,based on legal principles,through appropriate measures,the responsibility will be properly attributed and the data will be protected.
