On the Application of the View of Positive Criminal Law in the Environmental Crime Governance——From the Perspective of Crime of Environmental Pollution
From the perspective of crime of environmental pollution,the paper explores the positive in-fluence of the view of positive criminal law on the environmental crime governance in risk society.Based on the review of theories of the legal interests of the environmental crime protection,the paper suggests that the view of positive criminal law be applied in the environmental crime management and the effective align-ment between the environmental law and the criminal law be promoted on the basis of the social reality and crime prevention,achieving harmony between human and nature.
