Legal Protection of Property Rights of Enterprise Data in the Context of Big Data
Since the information technology revolution,enterprise data has had a profound impact on economic development because of its important economical value.However,the problem of unclear boundary in the process of enterprise data utilization caused some infringing cases,such as illegal data application,infringing individual privacy and so on.Although the existing legal protection modes such as civil law,intellectual property law and anti-unfair competition law are reasonable,they also show some limitations and cannot provide extensive protection for enterprise data.In order to release enterprises'worries in data utilization and increase the utilization value of enterprise data,based on the theory of"labor property right",this paper proposes enterprise data should be protected as a new type of civil property rights,and the protection system of enterprise data property right should be built from four aspects of right subject,right object,content and restriction,so as to improve the applicable tension of enterprise data.
