科技浪潮席卷,人工智能时代来临,自动驾驶技术的发展激化了技术进步与伦理规范的冲突.面临自动驾驶领域的"电车难题",首先对生命冲突时可否进行紧急避险的问题作出回答.在剖析避险正当化依据的经典学说时,发现无论是功利主义还是社会连带责任都逃脱不了被学界诟病的命运.为改变学术之僵化,综合两种理论的优点提出修正后的功利主义学说,既承认一般情况下生命法益的崇高地位,又在某些例外时刻允许对生命进行价值衡量.在符合严格限制条件的前提下,认可在自动驾驶程序中植入利益衡量程序的合法性与合理性.
How to Solve the"Tram Problem"for Autonomous Vehicle
With the advent of the era of artificial intelligence,the development of autonomous driving technology has intensified the conflict between technological progress and ethical norms.Faced with the"tram problem"in the field of autonomous driving,the first question to be answered is whether necessary defense can be carried out in the event of a life conflict.When analyzing the classical theory of the justification of necessary defense,it's found that neither utilitarianism nor social joint responsibilities can escape the fate of being criticized by the academic circle.In order to change the rigidity of academia,a revised utilitarianism theory is proposed by combining the advantages of the two theories,which not only acknowledges the noble status of the legal interest of life in general situations,but also allows the measurement of the value of life in certain exceptional moments.Under the premise of meeting strict restrictions,the legitimacy and rationality of incorporating a benefit measurement program into autonomous driving programs are recognized.
