Construction of Legal Protection System for Data Sharing and Cross-border Circulation from the Perspective of Personal Legal Interests
In the era of digital economy,data,as a basic resource,needs to be shared and circulated across borders to explore its potential value,but at present,all aspects of data sharing face security risks,and supervision in the process of cross-border data circulation is weak,which should be improved based on the protection of personal legal interests.In the whole process of data sharing,data should be classified and graded before data sharing,data intermediary mechanism should be introduced in data sharing to review data quality and optimize the connection mode between the sharing parties,and data should be tracked after data sharing to prevent data from being reprocessed and infringing on citizens'personal legal interests.To build a regulatory mechanism in the process of cross-border data circulation,we should draw on existing norms outside the region,review whether the data content involves citizens'personal privacy,adhere to the principle of data minimization and ensure data transparency,ensure the safe operation of cross-border data circulation channels,and effectively supervise the two platforms of data holders and data users.
