《生物多样性公约》影响中国环境法治的机制研究

摘要
《生物多样性公约》助推了中国环境法治的进步.然而明确公约是如何促进中国环境法治的,仍需要进一步研究公约对中国环境法治的影响机制.依据国际法对国内法的促进理论,从法治的促进、法治的扩散、法治的转化三个维度分析《生物多样性公约》对中国环境法治的影响机制.《生物多样性公约》之所以能对中国环境法治产生正向影响,既有公约本身的"良法善治"因素,也得益于公约流入国内的多种"软硬兼施"的渠道,更因为其与中国的生态文明建设需求相耦合.
Abstract
The Con vention on Biological Diversity has promoted the environmental rule of law in China.However,how does the Convention promote China's progress?According to the promotion theory of international law to domestic law,this paper analyzes the influence mechanism of the Convention on China from three dimensions,namely the promotion of rule of law,the diffusion of rule of law,the transformation of rule of law.The reason why the Convention has a positive impact on China is not only the"good law and good governance"factor of the Convention itself,but also the various channels through which the Convention is introduced into China.More because it is coupled with China's ecological civilization construction needs.
