The Connotation and Development Direction of Sports Arbitration in China
The revision of China's Sports Law in 2022 has effectively responded to the widespread calls from various sectors of society in recent years.Specifically,in terms of sports arbitration,emphasis has been placed on writing,with a separate chapter as an effective supplement to the Arbitration Law.In addition,it has also facilitat-ed the establishment of the China Sports Arbitration Commission and the introduction of the Sports Arbitration Rules and the Organization Rules of the China Sports Arbitration Commission.This article uses the methods of literature analysis and legal clause analysis to study the unique connotations of sports arbitration in China.It is found that sports arbitration in China has unique connotations such as the combination of independent operation and official guidance,the coordination of arbitration finality and judicial finality,the unity of principles and ex-ceptions,the intersection of legal and voluntary jurisdiction,the parallel mediation and arbitration,the combina-tion of anti doping and arbitration.The future development direction of sports arbitration in our country should fo-cus on improving the scope of disputes that can be arbitrated in sports arbitration,and improving the connection between sports arbitration and the internal dispute resolution mechanism of sports organizations.
