地震预警法律制度体系的构建与完善

摘要
国家地震预警工程要发挥真正的减灾实效离不开相应的法律制度的支撑和保障.与地震预警系统的建设进程相比,地震预警的法律制度建设呈现出滞后状态,制度建设工作亟待跟进和完善.地震预警法律制度应进行体系化构建,确立以《防震减灾法》为引领,以部门规章、地方性法规或地方政府规章为依托,以相关技术标准为补充的制度化体系,以确保地震预警法律体系和法律秩序的稳定性.构建与完善地震预警法律制度体系的工作主要包括:积极推进《防震减灾法》的修订工作,补充地震预警规范条款;在总结地方立法经验基础上,推进地震预警部门规章的制定工作;补充制定地震预警信息发布行业标准,健全地震预警标准体系;进一步科学地规范和细化地震预警法律制度的具体内容.
Abstract
The true effectiveness of disaster reduction of the national earthquake early warning system cannot be achieved without the support and guarantee of corresponding legal systems.Compared with the construction process of the earthquake early warning system,the corresponding legal system construction is lagging behind.Therefore,the legal system construction needs to be followed up and improved timely.The legal system of earthquake early warning should be systematically constructed,and an institutionalized system led by the Law on Protecting Against and Mitigating Earthquake Disasters,supported by departmental rules,local regulations or local government rules,and supplemented by relevant technical standards should be established to ensure the stability of the legal system of earthquake early warning and legal order.Specifically,the work of constructing and improving the legal system for earthquake early warning mainly includes actively promoting the revision of the Law on Protecting Against and Mitigating Earthquake Disasters and supplementing the normative provisions for earthquake early warning.On the basis of summarizing local legislative experience,the formulation of departmental rules for earthquake warning departments can be promoted.Complement and consummate industry standards of earthquake warning codes,and improve the earthquake early warning standard system.Make the specific content of the earthquake early warning legal system standardization and refinement.
