人工智能合成音乐的著作权风险及其化解

AI合成音乐以现有音乐作为原材料,其中包含受著作权法保护的音乐作品和音乐录制品."AI表演"对现有音乐素材的复制性使用、表达性使用和传播性使用使其面临著作权侵权风险.由于"AI表演"与著作权法上的"表演"之间存在解释论障碍,AI使用音乐素材面临合理使用豁免困境和规范授权困境,传播AI合成的音乐面临侵权抗辩困境.建议从著作权法表演者权条款的扩大解释、合理使用的有限豁免、法定许可的使用保障、音乐著作权集体管理的机制迭代四个维度化解AI合成音乐的著作权风险.
Abstract
Artificial intelligence(AI)synthesized music uses existing music as raw materials,including musical works and sound recordings protected by copyright law.There is a risk of copyright infringement for the reproductive,expressive,and disseminating use of existing music by Al synthesized music.Due to the explanatory problems between"Al performance"and"performance"under copyright law,AI faces the dilemma of fair use exemption and normative authorization when using music materials,and the dissemination of AI-synthesized music faces the dilemma of infringement defense.It is suggested to resolve the copyright risks of AI-synthesized music from four dimensions:the expanded interpretation of provisions of performers'rights under copyright law,the limited exemption for fair use,the use guarantee of statutory licenses,and,the iteration of the collective management mechanism for music copyright.
