Intellectual property law is a key superstructure closely linked to new technologies,and intellectual property(IP)rules should respond to,stimulate and guide the development of new technologies.The relationship between IP and new technologies should be reconstructed from a Chinese perspective.In facing the challenges posed by new technologies to existing IP rules,it is crucial not to adjust these rules blindly but to fully explore their inherent value.For these issues that are difficult to be solved directly,it is necessary to improve IP rules to adapt to the development of new technologies through governance approach,humanistic stance,and the classical problem-solving method.Emphasis should be placed on the principle of good faith,procedural exploration,and interdisciplinary integration.Ultimately,the IP rules should accommodate,adapt to,and empower new technologies,thereby strengthening the institutional supply to accelerate the formation of new quality productive forces.This will achieve the ideal goal of synchronizing the development of new technologies with the IP system.
