The rapid accumulation of knowledge resources accompanied by frequent intellectual creation activities and the expansion of knowledge dissemination channels,has gradually dismantled the barriers to knowledge sharing.This has led to open innovation becoming a mode of knowledge production at higher level.The open source movement with open sharing as its original intention has evolved from its early stance of critiquing the intellectual property system into a limited open source community that embraces intellectual property system.This evolution has expanded from open source software to collaborative creation mode,open source hardware,open patents,open standards,open data,etc.,resulting in the widespread application of open source business models with open source licenses as the core,and creating a variety of business rules combining open source and closed source approaches.This transition is driving the transformation of existing intellectual property system into a more advanced application model of knowledge production in the era of open innovation.At the same time,the knowledge sharing initially advocated by open source has gradually developed into knowledge control through multiple evolutions of licenses in market competition.This has led to potential monopoly risks within open source communities,such as unreasonable trading conditions,compulsory tying and refusal to trade.The open source field is not the same as the public domain.While it conceptually challenges traditional intellectual property law,it operationally seeks comprehensive protection through these laws of copyright,trademark,patent,and trade secrets.Therefore,it is crucial to re-evaluate the logic of using open source models to achieve business model innovation under open innovation and to address the negative effects of the intellectual property system on controlling knowledge brought about by market competition.
