The Pragmatic Turn in China's Legal Argumentation Studies
In China,"legal argumentation studies",commonly referred to as"legal argumen-tation theory",is an imported term.As a formal branch of legal theory,although it was introduced from the Western academia in the early 21st century,its theoretical explo-ration can be traced back to the study of legal logic that emerged in China in the 1980s.The research on legal argumentation in China started with the exploration of the applica-tion of logic in law in the 1980s,experienced a turn in legal reasoning in the 1990s,and a turn towards legal argumentation at the beginning of this century,collectively called"pragmatic turn".Through the pragmatic turn,it addressed the theoretical dilemmas in traditional legal logic research,paving a unique path for legal argumentation research in China and bringing it into alignment with international standards.
