As an original achievement of Xi Jinping thought on the rule of law in the field of public welfare protection,the prosecutorial public interest litigation system shows its unique institutional efficiency in safe-guarding public interests.Years of practical experience shows that prosecutorial public interest litigation can-not be fully compatible with traditional litigation,and the current legislative mode and practice have also hin-dered the healthy development of the system,so it is the right time to carry out special legislation on prosecu-torial public interest litigation.Promoting the special legislation of prosecutorial public interest litigation is not only an inevitable requirement to implement the arrangements of the CPC Central Committee and the NPC,as well as respond to the expectations of the people and solve practical problems,but also a foreseeable conse-quence because of its solid foundation consisting of rich theoretical achievements,active practical exploration and existing normative system.This special legislation should improve the current system on the basis of grasping the law of prosecutorial public interest litigation and absorbing the experience of judicial cases.Ac-cording to the actual needs of prosecutorial public interest litigation,the paper integrates the existing norms,designs a scientific legal framework,and clarifies the key contents of the system,so as to provide a systematic legal basis for the orderly conduct of prosecutorial public interest litigation.
