全国人大决定行权方式的全面规范化——以《中华人民共和国立法法》第68条为制度支点

全国人大决定行权方式的全面规范化是宪法全面实施的内在要求,因而其具有显著意义.2023年《中华人民共和国立法法》第68条特别规定,全国人大及其常委会作出"有关法律问题的决定"适用《中华人民共和国立法法》的有关规定.该适用规则成为全国人大决定行权方式全面规范化、制度化、程序化的一个最重要的制度支点.全国人大决定行权方式的规范化命题蕴含三个子议题:一是规范类型上,全国人大决定行权方式包含抽象规范性决定、具体规范性决定和政策性决定三种规范类型;二是效力原则上,效力分层原则、程序判断效力原则构成了全国人大决定行权方式复合效力原则的核心;三是拣选标准上,"形式与内容的合比例性"构成了全国人大拣选决定行使方式的总理据,经立法程序决定之拣选标准的本质是立法便宜主义的政策考量,非经立法程序决定的拣选标准首先要考虑法律保留原则.
On the Normalization of the Mode of Power Exercise in All Resolutions of NPC——Focusing on Article 68 of Chinese Legislation Law
The normalization of the mode of power exercise in all resolutions of National People's Congressl(NPC)is the inherent demand of the full implementation of the constitution,thus enjoying especially vital significance.Article 68 of Chinese Legislation Law specially stipulates that the related stipulations of Chinese Legislation Law shall be applied to the resolutions on legal issues made by NPC and its Standing Committee.Such rule of application has become the the most important institutional fulcrum for the normalization,institutionalization and procedurization of the mode of power exercise in all resolutions of NPC.The thesis of the normalization of the mode of power exercise in all resolutions of NPC contains three sub-topics.Firstly,in terms of the type of norms,there are three types including abstract normative resolution,specific normative resolution,and policy resolution.Secondly,in terms of the principle of effectiveness,the principle of stratification in effectiveness and the principle of effectiveness determined by the procedure constitute the core gist of the principle of compound effectiveness of the mode of power exercise in the resolutions of NPC.Thirdly,in terms of the selection standards,the"proportionality between the form and content"constitutes the general foundation for the NPC to select a mode of exercising a resolution,and the essence of the selection standards decided through legislative procedure is the policy-based consideration of economic rationality in legislation,and the selection standards decided not through legislative procedure shall be determined by first taking into account of the principle of legal reservation.
