On the Criminal Law Mechanisms to Effectively Eliminate the Stock of Corruptions
Based on the new anti-corruption situation,it is necessary to seek legal mechanisms to effectively eliminate the stock of corruptions within the existing legal framework.The elimination of the stock of corruptions means the elimination of criminal penalty to a large extent,it can be carried out in combination with such two systems of eliminating criminal penalty in the Criminal Law of China as the period of limitation for prosecution and the pardon.The limitation for prosecution is a conventional mechanism to eliminate the stock of corruptions,but it may take a long time and cost a lot,while the pardon is an unconventional mechanism to eliminate the stock of corruptions.It is recommended that the National People's Congress(NPC)makes a special decision at an appropriate time to establish an unified national anti-corrupt account,grant conditional pardon to the stock of corruptions perpetrated before the 20th National Congress of the Communist Party of China,and establish"getting-at-the-root-of-a-problem"measures to curb corruption such as the system of declaration and disclosure of public officials'family assets and key matters at the same time of cleaning up the huge stock of corruptions.
