On the Normalization of the Liability Determination in Maritime Investigation
The liability determination in maritime investigation is the activity of a maritime authority exercising maritime administrative power in accordance with the law,and its final result is shown as the conclusion of maritime investigation.Against the backdrop where a maritime investigation conclusion play a pre-determined role and is not subject to judicial remedy,it is necessary to normalize the process of liability determination in maritime investigation to enhance the scientific nature of the conclusion.To this end,under the guidance of the doctrine of administrative process,and based on practical predicaments and the needs of normalization,it is advisable to expand the existing process of maritime liability determination to cover the step of investigation and evidence collection and incorporate the control of preliminary conclusion.Based on this,it is necessary to,regarding four stages of liability determination in maritime investigation,i.e.investigation and evidence collection,fact determination,the formation of preliminary conclusion,and the control of preliminary conclusion,refine and clarify specific rules and special requirements for each stage.
