How to Understand Article 83 of Legislation Law:the Analysis Based on the Typology of"Regional Coordination"
On basis of the semantic understanding carried out in the legal system through typological thinking,"regional coordination"forms the third feature,i.e.the feature of power structure,in addition to the features of geographical space and economic function."Regional coordination"means that the parallel power units at the same level jointly solve cross-administrative boundary matters according to their respective authorities,so as to achieve the operational state of horizontal power structure with coordinated economic and social development.In the typological spectrum formed on basis of the changes in the feature of power structure,the regulated object of Article 83 of Legislation Law of China is not a typical image of the regional coordination,but a general image formed by the integration of vertical and horizontal power structures.The intervention of vertical power structure has led to the horizontal transfer of partial authorities within the"relevant regions"."Relevant regions"should be distinguished from"the administrative region in question"and not totally"within the administrative region in question".In response to the legislative needs of the"relevant regions"as a whole,three possible approaches are formed to achieve the"coordinated formulation",i.e.the platter-style one,combinatorial one and delegated one.
