摘要
林权抵押是国家集体林权改革的内容之一,其具有盘活林业资源、解决林权权利人资金短缺、推进资源配置市场化、加快农村经济发展的作用.然而,现行的法律法规及配套的相关制度并不利于林权抵押的健康运行.该研究从法律和实践两个层面介绍了林权抵押的现状,从法律规范、林权评估、林业保险、抵押登记、抵押权实现这5个方面分析了阻碍林权抵押发展的相关问题,并提出了完善林权抵押的相关立法、健全林权评估制度、发展林业保险制度、规范抵押登记制度、确保抵押权的实现等完善林权抵押的针对性建议,以期对我国林权抵押的未来发展起到积极的推动作用.
Abstract
Forest right mortgage is one of the contents of the reform of collective forest rights in the country.It has an inventory of forest resources,solve the shortage of funds,promote the marketization of resource allocation,and accelerate the development of rural economy.However,the existing laws and regulations and related system is not conducive to the healthy operation of forest right mortgage.From two aspects of law and practice,the status of forest right mortgage was introduced,relevant problems hindering the development of forest right mortgage were analyzed from legal norms,evaluation of forest right,forestry insurance,mortgage registration,mortgage realization,and suggestions for the improvement of forest right mortgage were proposed,including perfecting relevant legislation of forest right mortgage and forest right evaluation system,developing forestry insurance system,standardizing mortgage registration system,ensuring the realization of mortgage right,in order to play a positive role in future development of forest right mortgage in China.
