征地中失地农民保护的缺陷与修正

摘要
针对推进我国城镇化进程、保护失地农民利益的土地征收补偿制度,肯定其是城镇化进程中必不可少的手段,同时指出失地农民为我国城镇化进程做出了巨大牺牲,但我国相关土地法规并没有给予农民足够保护,对失地农民的保护举步维艰.分析了失地农民保护宏观因素和微观因素上的缺陷,进而从发展政策、补偿标准、补偿范围、补偿方式等方面提出修正方案.
Abstract
According to the land expropriation compensation system which to promote the process of urbanization and protect the interests of landless peasants,it is thought to be an essential means of urbanization process.Land lost farmers have made great sacrifices for the process of urbanization in China.However, China's relevant land laws and regulations did not give enough protection to farmers, and it is difficult to protect the landless peasants.This paper analyzed the defects of the macro and micro factors in the protection of land lost farmers, and then put forward the amendment scheme from the aspects of development policy, compensation standard, compensation scope, compensation method and so on.
