集体林权抵押的法律问题及对策
On the Legal Problems and Countermeasures of Collective Forest Right Mortgage

摘要
从集体林权抵押的法律涵义、集体林权抵押的主体、集体林权抵押的客体、集体林权抵押的权利义务关系几个方面分析了集体林权抵押的法律概念.总结了集体林权抵押的实践困境、法律制度障碍,在此基础上,提出了完善集体林权抵押的具体建议,强调从法律上明确扩大林权抵押物范围,通过法律规定合理延长林地承包期,完善集体林权确权登记、流转抵押登记和评估登记制度,建立政策性保险和商业性保险互补的保险制度.
Abstract
The legal concept of collective forest right mortgage is analyzed from the legal meaning of collective forest right mortgage,the subject of collective forest property mortgage,the object of collective forest right mortgage and the rights and obligations of collective forest property right mortgage.The practical difficulties and legal system obstacles of collective forest property mortgage are summarized.On this basis,some concrete suggestions are put forward to improve the collective forest property right mortgage,including legally enlarge the scope of forest property mortgage,reasonable extension of forest land contract period by law,improve the registration,circulation,mortgage registration and evaluation registration system of collective forest property rights,and establish policy insurance and commercial insurance complementary insurance system.
