摘要
阐述了"海变地"海域使用权的性质、权能及公法难题,分析了海域使用权变换登记的类型、效力及要件:《海域使用管理法》和《物权法》明确了海域使用权是一项物权,把海域变成土地并在其上开展建设活动,是"海变地"海域使用权的前后相继、不可分割的两项权能;新出台的《不动产登记暂行条例》规定,海域使用权和林权、建设用地使用权等都将登记在不动产登记簿上,海域使用权和土地使用权都将由国土部门统一登记.
Abstract
We elaborated the nature, power and public law problems of the right of sea use right about "sea change into land", analyzed the types, effectiveness and requirements of the registration of sea area use right:Sea Area Management Law and Property Law cleared that the right to use the sea is a property right, the sea area into the land and carry out construction activities on it, is the "sea change into land"to the right to use the front and rear, inseparable two powers;the new Provisional Regulations on Real Estate Registration stipulates that the right to use sea and the right to use land and the right to use land for construction will be registered in the real estate register.The right to use sea and land use rights will be registered by the land department.
