大型线状工程征地拆迁问题探讨

摘要
通过介绍征地制度的历史沿革,梳理出不同时期征地制度的特色.以大型线状工程的征地报批为例,阐述了征地报批和拆迁补偿的流程.着重介绍了目前我国征地拆迁补偿安置存在的问题,结合实践经验,在建立征地拆迁补偿动态调整机制、提高土地勘测定界准确性、有效解决失地农民的安置问题等方面提出了一些建议.同时对当前征地拆迁制度改革方向进行了探讨,包括简化征地程序,进一步提高征地拆迁补偿标准,完善征地拆迁补偿相关法律法规.对解决当前征地拆迁补偿矛盾的根源进行了探析,认为改革的最终方向是要破除城乡二元结构体制.
Abstract
The evolution of land requisition system history was described,to tease out the different periods of the land expropriation system features.In largescale land acquisition approval status of the project,for example,the approval of land acquisition and relocation compensation process were described.Highlights China's current land acquisition compensation and resettlement problems,combined with our experience in the establishment of resettlement compensation dynamic adjustment mechanism to improve the accuracy of land boundary survey,an effective solution to the resettlement of landless peasants and other aspects of a number of recommendations.While the direction of the current land reform were discussed,including simplifying land acquisition procedures,to further improve the land requisition compensation standards,improve the land requisition compensation laws.To solve the current land acquisition and relocation compensation for the analysis of the root causes of conflict,the ultimate direction of reform was to get rid of urban-rural dual structure system.
