Research on Legal Issues of Forestry Carbon Sink Trading Contracts
As a new way to reduce emissions,forestry carbon sequestration trading has been accepted by all countries in the world.China is al-so committed to building and developing the national carbon emission trading market,many provinces and cities have launched pilot projects,but there are still many legal problems in the practice of forestry carbon sequestration trading.Based on the perspective of forestry carbon se-questration contract,this paper is based on the relevant provisions and practices of carbon sequestration transaction in our country,to clarify the outstanding problems such as the lack of concrete laws and regulations,the narrow scope of the transaction subject,the unclear ownership of the transaction subject matter,and the fuzzy rules of the transaction risk-taking,on this basis,it is proposed to further promote the rule of law of carbon sequestration trading by establishing the applicable law of carbon sequestration trading contract,gradually promoting the diversifi-cation of carbon sequestration trading subjects,defining the ownership of the subject matter of the transaction,and establishing the rules of risk-bearing,boosting carbon trading.
